What Raj is saying is get your GC first and process your wife's through family based which would take a very loong time...10 years!!!

Now to my views..Your wife will be able to piggyback on your 485 application irrespective of her status H1-B or H-4 or F-1..She's your wife PERIOD...no problems there!!what i don't understand is this bangwagon "lets apply ours first and include our wife's petition later when PD becomes current"...Instead y not apply both petitions together when PD becomes current again!!Atleast you wouldn't have to worry what if my petition gets approved b4 my PD becomes current!!!And god knows how many years of H1-B extensions they would give you once you have your applied 485 receipt!!!At the end of the day it is your choice!!!

    Hello Everyone,

I am back again. This forum is outstanding when it comes to reliable information....

I work for a reputed US Consulting firm. They under-pay you and make you over work. They market fake resumes in a polished way. YES... IT is TRUE. Don't just blame the desi consultants.

I am on a EAD. I wanted to switch to hourly basis and wanted to see if there are any direct vendors who would be ready to pay better rates. Desi Consulting Co. is out of question. From my experience, Robert Half is bad too. Is there a better way to market yourself..to the employer?

Any help will be appreciated. !!

EB3 was like that most of the time. If you go back to 1995 all of the categories were current. China had cut off dates as more chinese than Indians were coming. From there number of H1bs were increased gradually. From 1997 they put cutoff dates and by the time 1999 things got worsened and there were 4 year waiting time and Many people were leaving country because of 6 year Cap of H1b. 1999 first time h1b cap was reached and 40% of them were Indians. In 1999 and 2000 demand for IT was so high and unemployment was record low US economy was in internet Boom. So congress realized that they need to do something. So they increased H1b(for 3 years) and recapture of GC and also AC21 was done. After Dot com Bust everything changed and outsourcing was so much and Indians were using 60% of H1b and equal number of L1. Still Indian H1b and L1 are increasing as there are more Indian consulting companies than H1b Cap numbers. So it will become worse for EB3 as there are so many restrictions of Eb2 unless congress increases GC quota. But it is going to be tough for any immigration reform as economy is very bad and unemployment is increasing. But if there is CIR there is a good chance of recapture bill to pass with CIR. Otherwise AC 21 is only way to survive here for those who filed I485.It is going to be challenging for those who not filed I485 as they have to survive as well they need to maintain immigration status

i am getting frustrated to see the bulletin everymonth and it never moves.
people applied in 2006 got their GCs. one of collegue ROW got when applied in 2007.

dont know whom to blame. why cant they understand our problems.
    r they least bothered.

    my PD is oct 2003-EB3

e-mail won't do it. Put it in writing or wait until 90 days passes from the receipt date
This is like the banana joke in an old tamil movie, it is over 157 days and the USCIS now wants to go by processing times which mention july 3rd processing date, which is still late, but then they will say it is just one day over your receipt date.

While this question may sound redundant, I want to make an honest attempt to understand it. How does creating media awareness translate into making politicians understand the complicated issues suffered by legal immigrants? Further do they give any weightage to the fact that the stories are in the media and therefore they need attention?

I am biased towards the opinion that we might have already run enough media stories. I believe that the real fight now is to convince the politicians to do something about it. Propaganda and lobbying is the only thing that works with politicians in this country. And you have to choose a medium that politicians directly refer to. Meeting politicians and their representatives in person is most effective I believe. With due respect to your views, Pappu, can we discuss some of these questions?

I agree. Our adversaries and friends alike have noted the media stories. What we need now is getting in touch with politicians, and action!

Seems to be a substantial number of 2004 cases.
Hopefully we should see approvals to all of them next month. This would guarantee progressive movements in the Oct bulletin when the new quota begins.

It was a great meeting. I was blown over by the enthusiasm of the folks. It was intended to be a casual get together, but beyond a point it became more serious:D We did have action items and we will communicate it through emails, we cannot post such things on public forum. We are working on the next event planning once we finalize the place and time we will get in touch with U.

can you hold these meetings on saturdays? weekdays are impossible for me with a 1.5 hr commute (common with most tri-state folks).

informal get togethers can be held at the flushing hindu center on sunday evening, at least for those who are hindus living in queens. (the majority here, i guess)

The Department of State has available a recorded message with visa availability information which can be heard at: (area code 202) 663-1541. This recording will be updated in the middle of each month with information on cut-off dates for the following month.

Employment Third Preference Other Workers Category: Section 203(e) of the NACARA, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.

    B. DIVERSITY IMMIGRANT (DV) CATEGORY

Section 203(c) of the Immigration and Nationality Act provides a maximum of up to 55,000 immigrant visas each fiscal year to permit immigration opportunities for persons from countries other than the principal sources of current immigration to the United States. The Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997 stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This reduction has resulted in the DV-2011 annual limit being reduced to 50,000. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.

For April, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers BELOW the specified allocation cut-off number:
Region All DV Chargeability Areas Except Those Listed Separately
    AFRICA 35,450 Except: Egypt 27,600
    Ethiopia 22,150
    Nigeria 14,100
    ASIA 19,250 Except:Bangladesh 18,350
    EUROPE 23,200
    NORTH AMERICA (BAHAMAS) 8
    OCEANIA 1,000
SOUTH AMERICA, and the CARIBBEAN 1,075

Entitlement to immigrant status in the DV category lasts only through the end of the fiscal (visa) year for which the applicant is selected in the lottery. The year of entitlement for all applicants registered for the DV-2011 program ends as of September 30, 2011. DV visas may not be issued to DV-2011 applicants after that date. Similarly, spouses and children accompanying or following to join DV-2011 principals are only entitled to derivative DV status until September 30, 2011. DV visa availability through the very end of FY-2011 cannot be taken for granted. Numbers could be exhausted prior to September 30.

    C. ADVANCE NOTIFICATION OF THE DIVERSITY (DV) IMMIGRANT CATEGORY RANK
CUT-OFFS WHICH WILL APPLY IN MAY

For May, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers BELOW the specified allocation cut-off number:
Region All DV Chargeability Areas Except Those Listed Separately
    AFRICA 42,000

    Except: Egypt 31,200
    Ethiopia 26,200
    Nigeria 15,450
    ASIA 23,500
    EUROPE 27,800
    NORTH AMERICA (BAHAMAS) 12
    OCEANIA 1,175
SOUTH AMERICA, and the CARIBBEAN 1,150

    D. RETROGRESSION OF FAMILY PREFERENCE CUT-OFF DATES

Continued heavy applicant demand for numbers in the Family First (F1) preference category has required the retrogression of the Worldwide, China-mainland born, and India cut-off date for the month of April.

Further retrogressions cannot be ruled out should demand continue at the current levels for some categories and countries.

Not much good news for EB2 and EB3 India. I hope folks realize and do the lobby day seriously.

If you really look at who is paying less and misusing the H1-B and L1 to manipulate the job market, its the big offshore companies who bring the less experienced folks from India/China and other asian countries into US. These biggies pay way too less (52 to 57K) to these folks than what the conultants who work for local consulting companies make.

They apply for 1000's of H1B's and L1's showing the positions in US but 60% of the folks works back in their offshore centers in China or India with H1B/L1 stamped on their passport. Question is, if they applied for H1B / L1 based on an existing position in US and gets approved, why is that folks are still working in India or China center? Doesn't that mean they faked the position?

When we consolidated the vendors and excluded all the local consulting companies to include only two of the big offshore companies, we have seen their consultants brought onsite leaving them after few months at our group to join local consulting companies for better pay.

To me, they manipulate the job market displace americans much more than the local consulting companies.

I truely hope CIS look deep into these manipulations and frauds as well.

I know companies paying only 33K per year in L1.

Let me guess, you are a pakistani terrorist. Now you are jealous that how come an Indian muslim win 2 oscars? How will you give out your hateful message to other pakistanis terrorists that indian muslims are being torchured, so you have to "save" indian muslims. Too bad, no pakistani got an oscar. I know why, because the terror capital of the world is going down the drain pretty fast.

I agree, you will be competing with all the illegals. But.....

    1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.

    2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.

    3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)

The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.

    Crazy,
I am with you. I ugree with you.
I have been vaiting for nearly 6 ears now to get my GC and I vill have no issue to ubandon it and re-apply in this kategory. What an apportunity.
Buy the vay how long have you been in Umerica.u jained this forums nearly 1 ear ago, and jast 2 posts. The poynt based cystum is stupid, it gibes independence to upplicants. uver lagic is really grate.

wasn't the flower campaign an 'effort by IV'?

Any way, I think you don't need IV's (for that matter any organization's support) to file a law suit. If you think USCIS is breaking the law, you can file a law suit with the help of a lawyer. A couple of $100 is all that would cost you.

    Care to tell me how?

It was lawsuit filed by AILA, efforts by IV and other groups that reversed the decision. Gandhigiri in this country has very little value. This country works on laws/court system. We need to get laws to help us and we need support groups like IV to make that happen. Or else we can pray to God to shower some green.

That apart Prudential has a term life policy where you get back the complete premium paid under this policy at the end of the term. say for a 30 year term you paid a total premium of 30K in 30 years,, at the end of 30 years if you are still alive you will get back the 30K..

    https://www.prudential.com/view/page/13088?SessionID=&CTRN=&OFFICE=&CampaignID=030343&LeadSource=pru.com&LeadType=quote&MainProductType=&UserID=

Do you know how much more the premium would be for this product compared to regular term? I am guessing a lot more. In that case whole life is better where the cash value generated would pay much more after 30 years based on a low 5.5 - 6% estimated annual return. But of course it is for folks who will stay in US at least 15 years+ because after 15 yeras the Cash Value could itself pay for the permium and you do not have to pay any more premuims unless you wish to boost the Cash Value further.
