Everyone wants to play it safe until they get greencard and then everyone becomes risk taker after greencard gets approved; because they feel uscis is no longer watching.
Have you ever seen an RFE; where a company is asked to account for all h-1b, L-1, I-140's and people who got greencard through the company and where they are?
I have seen it. It is where there is an imbalance between current employee headcount and number of greencard filings. This imbalance will always exist in staffing companies because everyeone eventually has to file labor/140. At certain points of time there will be more pepole who have gone for greencard then what the current headcount is.
There are limits to everything - and to worries too. Of course you don't want to be taking meaningless risks, but to live like a chicken is not an option either. But this is more philosophical, here is my question.
USCIS may send RFEs for whatever and whoever they think it's reasonable. They can investigate and reinvestigate and GC holders and citizens, it's their job. Now tell me. How many you know of GC holders who got denied their citizenships because they just threw away their W2s? How many GCs were actually revoked and people were deported because USCIS investigated company and found out that most of the employees were H1b?
Here is case of my cousin, he had his GC for many years, his wife and kids got citizenships. He didn't because he didn't accrue his 5 years in the US. He felt that he would be more successful in his home country. So he had business over there and was traveling back and forth to/from US. Once, at airport the immigration officer asked why he was traveling so much? He honestly answered "i'm doing business abroad". What do you think? INS officer initiated investigation and put him on deportation. Reason? "Absence of immigration intent!!!!". The case was quickly dismissed by immigration judge. My cousin was telling me how angry the judge was at prosecutors, he told them not to waste tax money like this anymore. So... what would be the right choice for him? Taking risk and making money (now he has a $1M house in LA) or be "careful" and live in some crappy hollywood apartment until his citizenship?

Friends, I read this article which is an opinion about President's immigration speech and loved most of it (coz it was quite unbiased and straightfoward opinion): Obama Fails to Square the Illegal-Immigration Circle - Victor Davis Hanson - The Corner on National Review Online (http://corner.nationalreview.com/post/?q=MWFlN2I4OTJmMWMxYzQwNzg5MDFiZmQxNmVkZTI2MWQ=)

I agree with somegchuh. This is for discussing the issues that somegchuh listed. People interested in talking about - which is better, immigrating to canda or going back to india can discuss this in a separete thread.

Everyone try to concentrate on how to save your jobs, instead of waisting time in predicting stupid things...."Visa Bulletins"
In any case the dates are not going to move further, after seeing the last months trend ...
Wait for your kids to sponser your GC's

Are you kidding me?
What does your lawyer say about it?
Does your lawyer know that your wife supports you?
If the person you committed the Violence on, is not ready to accept it, how are they even offering you battery?
If you did beat her, were there any witnesses? And do not respond to this question in positive.
There is definitely something missing here. You are either not saying the complete truth, OR your wife is not supporting you, OR you are suspecting that she will testify against you.
DA offered:
Keep on DV battery charge, no jail time, 52 weeks anger control class, 3 yr probation.

I totally agree..
If to get EAD and AP going to take more then year then what is advantage of VB becoming current?
When the EAD and AP dates processing dates are backlogged, there isn't much advantage to early filing.

Skilled Immigrants Turn to K Street
High-Tech Workers Awaiting Green Cards Hire Lobbyists, Hit the Hill
By S. Mitra Kalita

Wednesday, April 26, 2006; Page D01
On the December day when Congress killed a budget amendment that might have allowed him to become an American a little sooner, Aman Kapoor started a movement.
It is a great and very truthful piece - also comes at the right time! Maybe the 'pre-conferees' will read this!
This is a major, major advancement in exposure for IV!

I got a red for this
I mean when i say good news - someone needs a therapy:p
Would like to clear two things:
1) I did not give you red :)
2) Mine is TSC all the way from 140, no RFE, same company for 6 years + and still no result :)

I think this has been discussed on some other thread.. would it be a good idea to make the contributions public.. may be, this encourages others to contribute, when they realize how much more is needed to reach the monetary goal.
I attended recent meeting arranged by IV in Virginia and they discussed about all this info you are asking. I don't think core team can publicly disclose all this info. They even showed us the recent bill they got to pay the lobbying firm. So next time there is IV meeting please attend it and your questions will be answered in private but not in a public forum.

msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.
good point. let's start doing it then...
just my opinion..but festive occasions bind us as a community and yes that includes Eid and Christmas and the Chinese new year.
Diwali celebrates the victory of good over evil, let's hope we can all bask soon in a festival of lights by getting some relief from retrogression....
actually...and this is just me nitpicking now...Diwali is technically a Hindu festival not an Indian festival (since 20% of Indians are not Hindu), so the complaint may be more accurate if you point to the religious aspect...
Of course it is widely celebrated in India...and the UK and going by the White house greetings and the huge melas ...in the US :-)

Pappu,
Please let me know your thoughts..
I-140 is approved. I-485 was filed in July 2007. I have an opportunity to move to another company for a similar job profile. But the new company wants me to work as a contractor (hourly) on W2.
Is that a problem when filing AC-21?
Please advise.

Mr. GC_Rip,
Your are definitely a EB2 worth candidate. A company willing to support you and a good attorney is all you want. There are plenty who have qualified for EB2 with these qualifications.
Instead of MS, look for a good consultancy or a perm job which will do the trick for you. I do know/understand that it is hard to get consulting jobs and maintaining visa's for family members but look at the bright side, labor nowadays takes only about 3 weeks and 140 if you apply through PP, then you are talking 2 weeks again. You have a possibility to get out of this mess.
If kids from college gets into EB2 and gets GC in two years, You sure do sir...
OK now to members who think I am wrong can bash me but this is what I believe in, if a system can tie you down with stupid rules and no accountability on its workers, I am ok with a deserving candidate cutting the line ahead and getting his GC. Hail common sense.
Hi Bhasky25 : Please pardon my ignorance, but could you please advise in which state is the labor getting approved in 3 weeks? I am asking you this as I switched employers & I will be filing for labor certification in Mid Mar 2011 in CA. This information will be very helpful to me. Thanks.
