    Only when the democratic party weakens things can move forward for the skilled (EB- GC ) folks. Democratic party is never for skilled immigratiion, it is all for illegal masses only.

    Agree 100%. Atleast when Bush was in office there were bills introduced that encouraged skilled immigration Eg: Those who have been around for a while would remember the Cornyn-Kyl bill from 2005.

    Everybody likes to talk about the Clinton era, but don't forget that Republicans had majority then. So we may see good things happen after the November 2010 elections if dems lose majority in both house and senate. And it will be good for Mr.Bamster to govern from the center going forward than to hang out with the far-left, may even fetch him another 4 years.

    Immigration Voice Advocacy Days in Washington DC: 7th & 8th June, Announcement:2010

    With the continued success of the high skilled community to create more awareness for Employment Based green card backlogs, Immigration Voice will hold Advocacy Days, Press Conference and Congressional Reception in Washington DC on 7th June & 8th June.
    Every member must participate in these Advocacy Days events in DC. Congress will be back from Memorial Day recess in early June and there will be a fresh look at the Comprehensive Immigration Reform, which includes high-skills immigration.

    After having favorable consequences from our past effort, it is now time to have a bigger event in the front-yard of Congress in Washington DC, so that the long ignored issue of visa backlogs (retrogression) is addressed. This event will be hugely consequential as it will help our issues get much more coverage in the media and much more attention of Congress because of 2 reasons: It will be a really big crowd and secondly, it will be in Washington DC. Immigration Voice will arrange for meetings, advocacy material, and other logistics necessary for all the events during the Advocacy Days. All you have to do is show up.

    Please plan to take two day off on 7th & 8th June to attend these events. If you do not live within the driving distance of DC, then there is ample time for you to book travel by air or by train ahead of time. 7th & 8th June is Monday & Tuesday, and if you book your travel and accommodation ahead of time (and there is plenty of time still) then you can participate with minimal expense.

    Immigration Voice wants to do something as consequential as the flower campaign and the San Jose rally but only this time, it will be much bigger and much more consequential aimed at Congressional action on immigration reform to address visa backlogs and broken system of high-skills immigration. We aim to resolve this issue but we cannot do it alone and therefore it is imperative for everyone, and by that we mean EVERY ONE to show up. If you wanted to be a part of the past events but couldn’t, then now is your chance to make your voices heard and fight for a fair system and just process.

    Always remember, we are in United States at the invitation of our employers and our employers have filed our green card petitions in order to retain us. It is only fair and only just to ask for a system that achieves that objective without delays and without putting the immigrants in probationary limbo for 6-12 years. And it is your obligation to yourself and your family to stand up for your rights and ask congress to legislate and fix the system so that it works the way it was originally intended to work. Just ask a participant of September-2007 DC rally how proud and how satisfied everyone was after the rally – not just due to impact – but just because they have stood up and spoken up for their issue.

    In the two days, we plan on having over 400 meetings with the Administration (for both Admin and Legislative fixes), Office of Senators and Representatives.

    As we are beginning to take appointments on your behalf but we need your confirmation before we setup Advocacy day meetings for you.     My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development oppourtunities are limited due to economic reasons, but I there is no way toronto or vancouver can be considered "racist". And talking of high skilled workers, who said there is absolutely no discrimination in the US ? Isnt that what programmers guild and other labor unions are all about ? how come so many people support the blue collar illegal aliens (mostly meat-packers and lettuce pickers), but nobody cares about us, tax-paying, law-abiding highly skilled people ?

    The difference is at least the canadian immigration policy doesnt institutionalize the discrimination by making us wait in limbo forever, unlike the US laws. At the end of the day, I would rather live with "limited career development" opportunity in canada and change employers at will than be surrounded by plenty of such opportunity but have my hands tied behind my back by the US laws.

    As for "discrimination", we as immigrants always will have to bear with some discrimination,subtle or overt, from the native-born white collar workers whether in the US or anywhere else in the developed world. Our home country is the only one where you can expect to go and join the workforce without discrimination.

    * We reported yesterday that foreign professionals have been sending flowers to the heads of involved agencies with a message of protest for the ongoing visa bulletin fiasco. Dr. Emilio Gonzalez responded to such flower campaign in the USCIS site. The flower campaign appears to be a gesture from the community of foreign professionals to thaw out the tension created by the fiasco and at the same time calling the agency leaders' swift attention to the problem and sufferings of the foreign professionals and their family members.     Last year when I converted my out of state DL to a NYS DL, the DMV gave me a 5 year valid license (expiring on my DOB on 5th year i.e. in 2011) but on the fornt of the DL mentioned in BOLD RED the epriery of my I-797 date as 'TEMP VISITOR EXP.'.

    So guess I am good till 2011 ...

    I will be on EAD for the new job..and the LOA is vacation without pay. My salary is already 30% more than the one mentioned in labor but no promotions..new job has actually lower salary and job description similar.

    If i do ger rfe for evl with me in new job then I hope salary doesnot become an issue

    First it wasn't 1000, we had over 2000 people registered and many joined after or did not register. So please don't say 1000, it is extremely painful for everyone who attended to be considered as "not counted".

    1. Politically having a rally in D.C makes it more visible for all the law makers there. Laws/amendments and all the political activity happens there. Rallies else where would make it to one or two news cycle but won't be remembered after wards.

    2. Meeting lawmakers, staff from various constituents wrapped around an event like a rally helps a lot in getting the message across. It raises a lot of awareness.

    3. I would have agreed with you that numbers like 100,000 matters, but after being there and seeing the amazing capabilities of IV to organize meetings and having members meet over 100+ meetings with law makers, staff, talking to to them, sharing personal stories, advertisement and media campaigns around D.C has convinced me that it has and will make a difference! Personally for me, it was an eye opener on how the system works and I totally understood exactly why IV leaders set it up this way just by being around and them for a few days!

    So I think, USCIS must be accepting payments in various forms of payable to. I can update in one or two days about "payable to USCIS" - Whether accepted or rejected.


    I was looking into other info also about I-765 filing. The instruction is too old for students (Foreign Students).     Maybe we should tell NRA that lot of skilled immigrants will buy guns once they have GCs. That could be the fastest way for us to get some lobbying money. It could work faster then the message on "buying houses".

    I have lived in Nevada before. I think in that state and many other western states (where guns laws are more liberal) you have to have passport, I-94 and utility bills proving you have lived in NV for 6 months. That's it. You don't need hunting license to get a gun license.

    Here is the biggest irony:

    IN order to own a gun, FBI needs only 2 days to check your background.

    IN order to get 485 approved, FBI takes months or years to do a background check.

    I guess green-card is a more lethal weapon than a handgun.

    Change the language and target too. I am thinking to draft a letter to send Home Builder Assoc and Car companies that I am not able to buy Home and Car because I am not getting loan. I need a car and home as I am paying rent every month around 1500. I am willing to pay 25% down and have credit score more than 700. No any kind of violation. Paied off first car loan. I am experienced enough to find another job in such bad economy. The only thing that I dont have is GC for which I am waiting for last 8 years. If I get GC probably I will get good loan faster and cheaper. If you lobby for us for GC probably not only me many other immigrant will get loans.

    Never ever mention that it will improve economy.

    I am surprised...why IV is not raising this.. The fundamental issues of EB immigration wont' be solved until CIR happens and that could take forever. No one cares about immigration right now.. The only thing that can provide immediate relief for EB immigrants is if we express our desire to buy houses(unable to do so becoz of lack of GC).

    This is my thought process (also referred by Ron G):


    July 2007 brought in approximately 500K 485 cases.

    We do not know how many cases were pending as of June 2007.

    Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
    Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers

    so, 500K - 300K = 200K.

    Assuming USICS approval rate is 85%; 75K of 500K are denied.

    200K - 75K = 125K EB cases pending from the July 2007 cases.

    Additions: from all current categories - may be 25 K in 2 years?

    So, 150 K plus whatever that was pending as of June 2007.

    So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.

    Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.

    I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.

    Good analysis.

    This is the key stat here. It all depends on how many apps that are in the current category now get filed in the next few years. If there are no more new EB applicants, we should see all pending apps to get approved in a year or two max. The 4 current categories now are EB1 ROW, EB1 India/China and EB2 ROW. If there are 140K apps coming in every year from these categories, we'll never see any movement for EB2/EB3. Anybody know the average number of applicants the last few years from these categories? From the recent news, we know that demand for EB1 India and EB1 China has grown substantially. In my opinion, setting a cutoff date for EB1 India/China would be the best thing for USCIS to do now. That will prevent any new visa usage for EB1 India/China and allow EB2 and EB3 categories to catch up.

    Talk to a lawyer and get the answers. But if you're on travel and questioned by immigration upon entrance if you're still working for sponsoring employer, depending on the circumstances, they can take your GC away. So that's another scenario separate from an audit or citrizenship interview that GC jeopardy may arise.

    If circumstances change, like you getting laid off or fired, that's a different story. If the sponsor's intent changes, and that does happen, then obviously, you're free to move on. But you should be able to prove that, with say a termination letter, for example.



    Many of us will be facing this decision and it's good to know the risks and the answers. Imagine you got a GC and now you have a +20k offer from the other company. Staying with your current employer for 6 months will cost you 10k. The question is "does the risk cost 10k?".

    This is how I see it, please correct me if I'm wrong. You can be questioned about leaving the company only in two cases: 1. citizenship interview, 2 - investigation/audit. In first case I don't see much problem, as many years will pass, and if you will not keep any documents, I don't see how USCIS will be going back and chasing these 4-5-6 months of your employment.

    Investigation is a different story. You have to be ready. The law says that you/your employer had to have intent to work on that position with that job description forever at the moment of AOS. Technically you could change that intent the very next day.

    So.. I think this is how it will work. USCIS might request evidence/letters from you/your "after-GC" employer and if they will find something like your resume that you have sent them before getting GC, then you are in trouble. But if you will demonstrate, that let's say you met your "after-GC" employer only after getting GC (let's say at some exhibition) and he offered you right away +50k salary, then I don't see how USCIS is gonna build their case.
