Well, DOS is alerting that don't expect additional rapid movement any time soon. Here is the relevant part of their warning:

After all anyone in their right mind would not chance CP now with the fluidity of priority dates and the pending BEC deluge of cases, and the hordes of people hunting labour subs. etc. Basically if anyone gets the chance to file 485 they will do it lest the dates retrogress again while they are waiting for the consular interview.
So those with early 2003 dates can be hopeful now, later than march and I doubt you will be in this fiscal years quota.
Very true about the nurses and PTs. This will definitely lead to a lot of noise and I am quite sure the remaining 50K visas left for recapture for yrs 2002-2004 will also be recaptured soon after the elections. I hope for the SKIL provisions but am less confident about them than I am about the Schedule A workers.

I filed my I485/EAD/AP on August 7, 2007. Does this mean that I do not have to pay any fee for EAD renewal now ?

Can somebody clarify what it means that "salary is large enough" for EB2?
If a PWD was obtained from the state "workforce agency" and it has some number there, the job order has been placed with that number, can DOL and/or CIS later on (while processing PERM and/or I140) still say that the salary is "not good enough for EB2"? Based on which considerations and how are we and the employer supposed to know them beforehand then?

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?

I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
That company is MSU software based in Iowa ( just in case if anyone knows about it ) .
I tried several times approaching USCIS as well as Congressman's office to find the details of delay / extended review status etc but all I got was we need to wait until the review is complete.
I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .
I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .
I have sent the email to info@immigrationvoice.com just now.
Thanks folks for all your support. it really helps that some is there to here the concerns and provide suggestions .

My own case got denied by someone who'd only been in the job for 2 weeks and she denied it because she said I didn't provide a document which was not only provided, but they had two copies! AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

I hope the admins keep this thread open and not kill it. I am not sure what the intentions of the OP ( some of you claimed that he wants to create a rift ), but this is definitely a valid concern for all the EB3(I) guys. This is a natural reaction to the frustrations of EB3(I) guys just like the mass upheaval during the July 2007 VB fiasco. Since it was across the board, there were no differences. Now since this involves only EB3(I), there is not much support from IV or others. But in my opinion, this is as much unfair as the Julay VB fiasco.
Some of the EB2(I) guys are worried that their GC dreams would get delayed if there is any Admin fix for EB3(I). For all those individuals in EB2(I) who want to oppose any kind of admin fix for EB3(I), I just want you to think about it. Is it really fair? There are individuals in EB3(I) waiting since 2001 - a total of 8+ years. Don't get me wrong - but some of the EB2(I) guys who have applied as late as 2006 and 2007 are expecting/hoping to get their GC this year if there is a spillover. And I think these are the individuals ( not all of the EB2 guys though ) who are opposing any kind of admin fix ( please dont yell at me or curse me etc...if you are not one among those mentioned, then please dont worry..this is not about you::) Ofcourse i would like each one of us to get GC as soon as possible) to EB3(I).
And I dont see why there will be a rift between EB2 and EB3 if each of us follows net etiquette in positng responses. Let's do some constuctive brainstoming - without getting into perosnal attacks or getting too emotional. Let's do what is right and not what each one of us thinks is right. Then I guess there wont be any rifts. The only thing I am asking is to get EB3(I) to advnace a little bit. I am not asking for it be on par with EB2(I). I hope some of you see a point in my frustration::))

We need more participation from our members on such tasks in order to highlight our issues in the media. We find a lot of people posting messages about what we ought to be doing on the forum but only a handful actually do when we urge members to do. Any efforts to get attention from media to highlight our isues will be highly appreciated.

One of the least heard, but the most pressing issue that continues to plague day-to-day lives of thousands of high-skilled legal immigrant workers in the US is Retrogression causing deep anxiety, frustration and considerable delay in processing and approving of permanent residency, also called Green Card.
For employment-based green cards, every country has a fixed number of immigrant visas or quota on a per-year basis. When I-485 adjudication or adjustment of status from non-immigrant to immigrant status (example H1-B to Permanent Resident) successfully concludes, it leads to approval of green card. This approval requires a visa number to be available. But, if the visa quota for a country has been used up, visa numbers become unavailable for that country. This unavailability of visa number is the effect of retrogression, wherein, the US Department of State, based on the current demand for the visas decides allocation of how many visa numbers can be released to meet the demand and be in conformance with the pre-set quota.
Employers file for green cards for skilled professionals to obtain a legal immigrant status for future employment. Skilled professionals who have green card processing pending typically wait for their green cards to be approved for an average period of 5 years. During this period, they have very limited, if any, freedom to exercise choice with changing jobs, or getting a raise or promotions, being with the same job, title, position and employer with no way out until it gets approved. The only way out would be to risk losing your green card or having to start all over again. Family members of such skilled professionals share the pain as well. Spouses who would like to obtain jobs and attain financial freedom do not have the legal rights to work until they at the least have an employment authorization. Children of such professionals who apply for college cannot benefit from federal government loans, but instead need their parents to seek private loans. Becoming a legal immigrant has become an increasingly challenging and frustrating experience as has been noted by the experiences of each individual of this community. Unless a legislative reform is made, green cards are not only going to be tough, but also seemingly impossible to materialize.
Immigration Voice, a non-profit organization in the US, founded in Nov 2005 has begun grassroots level effort to alleviate the untold sufferings of high skilled professionals and has been working actively through volunteer members of the organization, that has grown to 9,000+ members in just more than a year. Immigration Voice recently hired Patton Boggs, a top public affairs firm for lobbying efforts towards the immigration goals of the high skilled worker community. Immigration Voice is now heavily engaged pursuing CIR or the Comprehensive Immigration Reform which will be introduced in the Senate in early March 2007 and then proceed to the House before it will be signed by the President to be enacted. This may very well be the ray of hope for the thousands of immigrants stranded on the not-so-green-now land of green cards.

Immigration Voice, a non-profit organization in the US, founded in Nov 2005 has begun grassroots level effort to alleviate the untold sufferings of high skilled professionals and has been working actively through volunteer members of the organization, that has grown to 9,000+ members in just more than a year. Immigration Voice recently hired Patton Boggs, a top public affairs firm for lobbying efforts towards the immigration goals of the high skilled worker community. Immigration Voice is now heavily engaged pursuing CIR or the Comprehensive Immigration Reform which will be introduced in the Senate in early March 2007 and then proceed to the House before it will be signed by the President to be enacted. This may very well be the ray of hope for the thousands of immigrants stranded on the not-so-green-now land of green cards.

Could you pls help-
What is I140 tracking number? How to get it?(I don't have any info about my i140 - only that it was approved and I have h1 extension petition of 3 yrs based on that.)
And did you request part info or full info therein? Your case is a light in tunnel- you got the info in about 3 months - right?

What heppens if i have AP and go for H1 revalidation...the h1b gets rejected/delayed..can i come back in AP?

Sorry to hear abt your situation. But buy some insurance either thru COBRA or just generally. Dont go to emergency room without insurance. Not a wise idea.
The last thing you want to worry abt is medical insurance.
I know couple of states like atlanta & texas with out having insurance also they will admitted the pregnent people.
