I oppose the Senate immigration deal in current form.
Immigration Reform unfair to the legal high-skilled. Legal First
We are always told, Break the law, and you will be in trouble. But, the recent Immigration Reform Grand bargain proposes to send a message that is precisely the opposite.
We are being told that no undocumented immigrant will get ahead of those in backlog. While the backlog of Family-based petitions has been highly publicized, the petitions of individuals (engineers, scientists, doctors and other professionals) are being left in legal and bureaucratic limbo. About half-a-million highly qualified professionals and their families have put their faith in the legal immigration system and due process of the United States, while working to enhance the US economy. These people have pending petitions either with the Department of Labor, or with the CIS, the final adjudication of which will enable them to work with a US employer, with consequent ripple effect on the US economy.
In the old system, employment-based petitions were limited to 140,000 per year, but the proposed system, in order to reduce backlog, reduces them to 90,000 per year only! On the contrary, Family-based cases used to be limited to similar numbers, but now have been increased to 567,000 per year! In addition, close to100,000 of these applicants with pending petitions are being asked to start from scratch in the new system. In effect, it is similar to changing the rules or rather, the Laws after the fact! Innocent high-skilled prospective immigrants are being penalized due to bureaucratic delay in the DOL.
Highly skilled doctors, scientists, engineers, and computer professionals have been stuck in backlogs since the last 3-4 years. They had hoped to get relief from the Immigration Reform, but have been let down badly. They are being forced to renew their H-1Bs yearly now, while the old system allowed 3-yr incremental renewals while their Green Card petition was pending. Seems like a fitting reward for following the Laws, isnt it?
Per washintonpost report, USCIS on purpose delays the process and keep backlog to earn the extension and renewal fee as 20% of their budget. THIS IS CALLED SCAM.
Your attention and help requested on the matter.

just made some additional monetary contribution to the cause.
Keep up the good work!!!
Quite frankly, I did not want to reply to your post, but your repitition above forces me to!
1) You have NO idea what it was like to find a lobbyist ready to work with us given a) We are dealing with a very sensitive issue b) We had only 10K in cash (5K raised by core members) and another 10K promised again by the core team. Do a real exercise and get a lobbyist to sign a contract with you for after revealing to them that you have only 20K. Try it now with even 50K and see how many lobbyists are ready to tow your line
2) Regarding your talk of Erin Brockovich and all, you do not even seem to grasp the fact that AILA is interested in the 11 million undocument workers. 500,000 skilled workers are nothing but a drop in the ocean compared to them.
In any case, have you done your part in contacting AILA? We have! Its easy to sit on the fence and complain but it takes conviction to actually DO something
3) Do you have any idea how difficult the task is to get amendments in? Do you know how much a fine balance the Republicans and Democrats achieved and are not ready to take on anything that might disturb the balance? Also do not forget that 500K people is not even 1% of the US population but 11 Million illegal immigrants make a sizeable chunk and alsong with Hispanics make more than 13% of the population. Now given this, who would you as a politician try to appease? 13% of the population or 0.1% of it?
4) And what made you think that faxing celebrities is an idea of the core team or QGA? Please read the posts again. It was an idea by a member!

Sorry - Not everybody is(or wants to be like) Narayan Moorthy.
I bet Narayan Moorthy doesnt have time(if not willingness) to clean his toilet NOW. Maybe we wud have when he was younger(before Infosys) which is a different stroy altogether.
I always cleaned my room, in India and here. What's wrong with that? Infosys founder Narayan Murthy cleans his own toilet (as per his own admission to a newspaper). Does it make him an 'inferior' person to you? Don't you vacuum your room every weekend? Does that make you any lesser person? Ever heard of dignity of labor?
You wrote - "Humans, listen, life is not 1000 years, it is very short, dont waste the best part of your life waiting for gc". So what are you doing ? Not waiting for GC? Then why are you hanging around? There are good opportunities back home . Those sitting in deep-sh*t shouldn't be throwing muck at others stuck in the same sh*t.

OK my conclusion:nature exists but not GOD.
For you
it's nature = GOD
I mean
nature = Rama/Krishna etc..(If you are a Hindu)
nature = Jesus(If you are a christian)
nature = Allah(If you are a Muslim)
.
.
.
Both are Same ( Just a different term).
What ever makes you happy believe that.
Some People believes in term "God" and Some believe in term "Nature"
World is big enough So that both "nature" and "god" words can co-exists.

FinalGC,
Thanks for posting the above Op-Ed. I was the one who wrote it back in Sept. 2006.
What we need this time around is a basic introductory article describing the Green Card journey to the general public overseas. We will address retrogression and other more specific topics in subsequent articles later.
Best Regards,
Salil

I didn't think my answers were making fun or teasing anyone - sorry if you felt that way, I didn't mean them to be interpreted like that.
The main problem is that no one really knows for sure whether these steps are taken in sequence. There is little to no transparency. There are procedures, but we can not guarantee that they are followed.
To answer your second part. No, I don't believe there are any standard updates that indicate this, but I could be wrong. I think that there is an update if you clear it, but not if you are stuck in it. Make sense? Pappu has an excellent post that details the name check process http://immigrationvoice.org/forum/showthread.php?t=12000
To answer nlssubbu with the query about the "pre-approval" - I don't think it is a 1 time thing. Its a fairly standard USCIS practice. I have a link somewhere to the IO AOS processing manual. If I can find it I'll post it here.
Do I think they have enough resources to process them all? Absolutely not, but I doubt there will be a rush considering PDs won't be current for a while (esp eb3)
Thank you.

There has been time check used to be payable to:
U.S. Department of Homeland Security - USCIS
Now at some places it is shortened to:
U.S. Department of Homeland Security
And at other places it is shortened to:
USCIS
I think, they are interchangeable.
On USCIS site: Fees should be made payable to Department of Homeland Security or U.S. Citizenship and Immigration Services. refer to first dotted instruction of http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=db029c7755cb9010VgnVCM10000045f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD
It does not talk about putting US in front of Department of Homeland Security. Going exactly by USCIS instructions, lawyer did mistake - but it is OK.
Look at the PDF file for I-765 and I-131 Instructions from USCIS website (Checkout page 8)
http://www.uscis.gov/files/form/I-765instr.pdf
http://www.uscis.gov/files/form/I-131instr.pdf
Here is the relevant info from the USCIS instructions:
Use the following guidelines when you prepare your check or
money order for the Form I-765 fee:
1. The check or money order must be drawn on a bank or
other financial institution located in the United States
and must be payable in U.S. currency; and
2. Make the check or money order payable to U.S.
Department of Homeland Security, unless:
A. If you live in Guam and are filing your petition
there, make it payable to Treasurer, Guam.
B. If you live in the U.S. Virgin Islands and are filing
your petition there, make it payable to
Commissioner of Finance of the Virgin Islands.

How bad it can be for those with approved I-140?
Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.
I still don't get it?
Bad for retrogressed.... backlog will increase phenomenally 'cos of decreased visa numbers
This bill is a massive attack on us; we should put all our efforts to oppose and kill the bill. There is little chance that we can get amendments to reverse the potential damage that this bill can do... that is disaster for us.

As I said before
"EB3 I and in general all EB applicants need a solution now.
Until this process becomes so painful for us that we either go back or do a mass movement to get some legislative relief there are no better days for us."
As current bail out clearly points out that for any change to happen in this country situation has to go extreme.
So unless....
when new immigrants stop comming because of GC issues and current immigrant leave enmass
or
we do a some big enough show for our needs (not a single rally but something all over the country)
.....there are no better days for us.
This is indeed a gloomy and (in my view credible) story. The only thing possibly that can help us within the current laws, is the visa overflow from EB1 and EB2 ROW.
Lets hope for the best. The Nov. Visa bulletin will be confirmatory.

Now that Democrats have taken the house and will soon bid adieu to rabidly anti-immigration Republicans in key posts like Sesenbrenner and Hastert, it does bring in a new ray of hope for us.
What this means for us in two houses:
Senate:
- To get anything done in the Senate, a bill needs support of more than 60 votes.
- Even if Democrats control Senate, which we will find out after a Virginia recount, they will really have to work in a bi-partisan manner. If we look at past trend the Senate was open to immigration reform.
Lower House:
- Due to "majority of the majority" rule by soon to be former house speaker Hastert, NO non-conservative agenda saw the light of the day in last congress.
-This effectively turned into a do-nothing congress.
- New Democrat speaker Nancy Pelosi brings hope for millions.
- This is a good chance for Bush to show what he can rally around all Americans not just the conservatives.
This election has shown that the American democratic system does work and that there is still hope for immigration reforms.
Maybe, this is too early to celebrate but I will go out and have an ice-cream :o some good news after a long draught
