Look, the H1 quota was not sufficient even when it was set at 115,000 pre-2000. It was only when it was set to 195,000 in 2001 that the quota exceeded demand. Now thanks to the report by USCIS last year, we know that about 20% of the H applications had fraud or technical violations. Even if you assume that the USCIS does a perfect job and catches this 20%, the quota that will be freed up won't be enough for the rest of the applicants.
The issues we face have less to do with fraud and more to do with the anti-immigration forces who dislike the 1965 immigration law. Claiming fraud, cheap labor, harm to the environment from increased population are just convenient means to couch opposition to permanent immigration in.

Similarly, it would be illogical to think that delaying issuance of a green card or U.S. citizenship will prevent a criminal from committing a crime. Considering the protection the FBI name check provides, the cost of government resources used, and mental and actual hardships to applicants and their families, USCIS should reassess the continuation of its policy to require FBI name checks in their current form.

yeah.. So another reason to keep looking at the visa bulletins now. Once i get a GC I buy a house and get a gun. The american dream. ;-)
Thats my kind of dream. Just one addition to my list of things to do upon receiving my GC.
I will buy a house, get a gun and JOIN A LOCAL RELIGIOUS PLACE and choose my lord and savior. Hey, I want a passport to the heaven from here, I don't want to stand in green card line of heaven or go to hell.
BTW, move over here to WA state and you can buy a gun.

This is not good. My PERM labor is stuck in Atlanta, I was hoping to apply I-140 pp since my 6th year H1 is expiring Dec, 07. If I can get my I-140 approved then I'll have to leave.

Applied for EAD extension on July 18-2008 (expiring on Sep, 2008), less than 90 days. Today (Aug 15, 2008) received an email saying "Current Status: Card production ordered." for self and wife. No idea whether it is 1 year or 2 year extension. APs are still spending.

As long as you dont use your EAD, you can continue working on H1B.
In fact, if it is the same employer as your GC sponsor, you dont have to do anything.
The thing to remember is to extend your H1B if you do a H1B transfer so you dont have any issues at the time of transfer.
All this is assuming that your company policy can handle exceptions to the policy :)

Even in that case, all the benefits they were hoping to get from increased fees will be lost - and much more than that.
Average fee hike is $500 but average reimbursement of expenses would be atleast $1000
As per various lawyers' web-sites -- It is highly unlikely that there will be reimbursement of expenses even if case is won.

Based on what's mentioned on AP form 131, she need to be present in US to file for renewal and if she travel outside the country during the time of renewal, her 485 application would be deemed abandoned.

actually, lets make another category 3.c. people who have shifted jobs after ead using AC21 and now want to or already have started a company for side business (that may be in the labor/perm cert job description or outside)...
So, I am 3.c. and so is perhaps matreen... after digesting my conversation with the lawyer for two three days now, i am feeling that it might be worth taking the risk of doing a side business. after all, we are not doing anything that is uncivil or criminal... just trying to boost our incomes and perhaps contribute to an industry or something like that... that noble intention could be viewed as an exclusive intention in relation to the intention to continue permanent employment with the new GC sponsoring employer... what do you guys think?

1. Copy the link on your clip-board (highlight and Ctrl+C). E.g., the following is the link for TSC

2. Close *all* your browser windows. Perhaps you might want to open the task manager and kill the "process tree". But simply closing *all* the browser windows was sufficient in my system.

They could be using some distributed web caching like akamai.
