Hi All,
You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!

We all will have to work to make the injustice visible; only then will the employers start behaving.
We all remember there used to be a IV voice member who used to leave abusive comments to everybody. Once we all made a hue and cry about this Pappu took action against him by disclosing his identity and since that day we have not seen any complaints by members.

I think there is another issue here. lets say you file for your 485 and you get married later in teh year..by that if PD retregresses again, your spouse wont be able to file for 485, since she gets your PD. so you might get approved sometime next year and you will loose your h1b status, then it gets to be a problem for the spouse since she is still waiting for PD to retrogress..so please talk to a lawyer and get all the facts...

go stand in line for a Z1. The documentation required is flimsy (some affidavits).
if a background check reveals that you had been on H-1 you won't be eligible for Z visa. You have to come up with a new face, new name, and new ID. Looks daunting but less daunting than getting GC legally.

My case I-485 (marriage based) was received in Oct 2005, NC initiated Nov 2005, interviewed Feb 2006, pending name check since.

If it has been more than 6 months since you last entered the US on your current visa, then you need a transit visa to go via London. Go to www.britainusa.com and search for the exact regulation.

What is IV's position on more H1Bs?
IV does not support, nor oppose H1-increase as far as I know, that is not on the agenda at all. IV was formed by and for EB -applicants to ease some of the hardships faced by the EB Community and to end the visa-number unavailability and retrogression.

IV core is doing a great job. One can't ask more of these great guys (and gals)!!
Although I support the idea and my spouse would be benefited by it, allowing H4s to work is a whole different ballgame and way more controversial than the current IV agenda. Your spouses will be able to work once you and they get EADs (although I know you will have to renew annually)...this is way more reasonable.

I completely agree with you. The best thing the forum can do for such people is to educate them and the best way to do that is with case studies of what situation were people in and how they fought back. It easy to tell people to take the plunge, any one will hesitate to jump into darkness.
I think we should also hear from people who have taken action and what their experience was. This may give ideas to others.

this seems to be the plan all along. Keeping pushing the ammendments and divert the discussion from the actual issues. A tactic to run down the clock, shows that he is doing something but nothing gets done. Helps the anti immigrants but royally screws us. Same will happen in the House and Senate if this thing moves forward....just venting after watching this snail crawl..god knows why they waste taxpayer money by adding ammendments and wasting everybodies time.

I suppose it is a good thing to stop this practice, which seems to be abused a lot. Hopefully, it will put everything in order and people will be treated fairly. :D

Thanks ak27... based on your suggestion, I have started enquiry on my case through congressman.
I also talked to second level I/O and she told me that it may be due to pending biometrics (what a relief to hear that). She didn't give me any other details so still not sure what's going (no SLUDs yet). I haven't recd any finger print notice since my first one in sep'07 so that kind of makes sense.
I had a infopass appointment today, IO informed me that my fp expired so that may be the reason for not approving I-485. He told me that my application had some activity on July 29. Later I contacted my congressman's office and they informed me that my fp will be refreshed and I dont need to take new fp.

From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.
If this law does not apply to existing labors, we will still be in the same situation. BTW, what is a desi company. How come it can sell labors? Is selling labor legal?
