    Nixstor did explained his actions and I concur... Controversial handles should be banned... Handle "TALIBAN" was banned and same member opened new handle "TAWLIBANN" saying his name is Tawlibann Foggs...

    Anyway we should close this issue.. I do find tawlibann's posts decent and non-offensive.. Only thing is we need to practice some respect to the communitity when chosing a handle... Its just not this.. there could be potentially other offensive handles.. So I'd say there should be a step/check in registration process to monitor/regulate handles... You won't like any handle offending your religious beliefs, dis-respecting your nation or humanity itself...

    Just my 2 cents... We should stop this discussion and focus on immigration issues...

    May be obscene name: Humm ..much better than existing F---GC,fuckadothead, chumki, chumma, xxxx, coolhokie, ussexy, saksibaby, funkycatspangky, faaltoo and plenty ..check the member list.
    May be obscene posts: No...his posts were very decent. He pleaded his case very politely. Never lost his cool even after being banned without being told.
    May be meaning of Taliban is wrong: No, It means..someone who is seeking religious knowledge. Nothing wrong in it.
    May be bad relation with US: Humm, US may not have good relations now, that was not the case earlier in late eighties and early nineties...not too far back..;)
    May be having political cause: What about existing handles like FREE_KASHMIR, us-alien...etc
    May be reference to terrorism: Having a same name "AbstractVision" as a terrorist organization somewhere in remote part of the world doesnot make me a terrorist.
    May be religious name: Humm...not like existing jaihanuman, saibaba,saint.. .etc
    May be country specific: Hum...Jai_Hind, JisDeshMeinGangaBehthiHai etc.. more than 500 handles have meaning related to India and in Hindi, Tamil etc
    May be phone call was not received by proper person: Humm..did someone tell him to expect a call..;) Being a member doesnot to be glued to phone 24 hrs waiting for someone to call. A private message with time would have been the right way.
    May be phone no. was fake: I had my previous cell number in my profile that I used 2 years back. I corrected this evening after this interesting post. I wasn't red flagged.
    May be handle name was a distraction: If handle names are distractions, I wonder how far can we go....no offense. We have got bigger problems to deal with.
    May be incorrect details: Why would I put my correct details on the internet. Didn't someone educate me about Identity theft..;)
    May be user was unaware of unpublished nomenclature: That sounds like the case. May be admins would like to publish the pool of words they are comfortable with and that may not be distraction.

    No offense, but without letting the guy know beforehand is definitely not up to the mark. Give this guy a break.... . Lets not apply any rules retroactively....more than 80% of the handle names are ridiculous and does not seem to be coming from intelligent folks and people with exceptional abilities.

    I agree we should respect other members and names should be decent..but I do not agree that names can be regulated by forum administrators with no set rules of engagement ....so many languages in the world...one decent meaning in one country/language can be offensive somewhere else.

    What wonders me is that SO MANY easily understood obscene words in memberlist as handle were allowed by admin (F---GC,fuckadothead,xxxx,ussexy etc ) and 'Taliban' got hit by a 800 pound gurilla..;)..got banned....

    I am looking forward to a REAL issue discussion and get over this handle issue. Lets move on...

    Didn't we have these discussions over and over before? and the admins telling us to stop because IV goals are set and will not change?
    If you just want to argue and waste time, lookup previous threads discussing this and you'll have enough reading material for weeks to come.

    Because he does not care whether his personal agenda born out of righteous anger (politics doesn't care whether your anger is righteous or frustrated) fractures the already divided community. He thinks that he can get out 15-20 guys on the hill and get a 2 line bill that will end country caps. Well, Why not talk to his friends and get them on the hill? No, he wants to ignore the bylaws/agenda of this organization and wants to carve a separate faction on IV that will work for ending country caps. If some one does not know that he is doing a mistake, we can try to help him see the mistake. If he/she knows it, Do we need to tell him/her?

    Can anyone confirm if the files are actually being transferred from Nebraska to Texas? Why is the compliance date for Texas 10/26 and for Nebraska it's 8/1.

    Why would files be transferred from NSC to TSC. Didn't USCIS issue instructions to file everything at NSC. Life is getting more complicated each day.

    One year 140,000 EB based visas available. If some how some of the back logs are eliminated, the future looks good as 140K for a year and less than 100K labor certifications per year. If the USCIS process with maximum visa/year, it is possible.

    If they can approve ~ 150 k total EB cases per year @ ~12,500 / month, with EB3 used up for the remainder of this year, they can definitely process at least 25 k during Aug and Sep.

    They adjudicated lot more 485s than 25 K last year. This massive adjudication was the reason behind threatened withdrawal of July 07 bulletin.

    what i am saying is how and why is it that inspite of the PD having been current as I detailed in my original post for so long during 2000-2005 for EB 2 India, why are there applicants from way back in 2002 and 2003 still waiting?

    Honestly, I thought they should have been already processed and gotten their Green cards by now.

    All I am trying to figure out is how many applicants from 2004-2005 are still in the proverbial 'PIPELINE' waiting. Unless they are done, the PD is not gonna move.

    If we can have it move conclusively to 2005-2006 regions relatively quickly, most problems are solved.

    BTW, what are the chances that the PD may become "Current" again for EB2/EB3 India over the next 40 months?

    I disagree that it effects EB Community for EAD holders. COming on to options if the amendment stands it might take the form of TARP - God Forbid. Everyone of us predicted Financial industry has so much clout etc.. but those days are gone. I think US companies have decided to bend to laws and find ways to overcome them.

    Reg. Options : we are here to earn bread. Just FYI for countries like Canada they have already closed gates. for Ppl who already have PR's over there life is not easy as "is" here right now in getting jobs. Moving the all operations to different country is only possible for companies like Microsoft. not all. btw no one will hire undocumented.

    So we need to really motivate ourselves and friends against this headless draft version. This is not first time it came in to light everytime there was a immigration issue it used to come on top. But it failed as climate was cordial for immigrants or economy was good. Things have changed far far beyond in 2008 and TARP bill restrictions is one example where companies decided not to hire H1B at all (mostly) even it applies to TARP recipients.

    My thoughts.
    I humbly disagree with you on TARP analogy. TARP was due to direct funding by Government to save "Too Big to Fail" companies and obviously they had a say in that case since it was tax payers money. The focus was only on those limited companies. Having said that this text has a wider repercussions and doesn't spare anyone, whether they are financially sound or goverment funded.
    I completely agree with you that US offers better job prospects and earning potential. However, when the noose around the neck turns tighter with such "headless" bills, people will sooner or later, start looking at options.
    Trust me companies don't hesitate to move on if the environment isn't business friendly(reasons are higher tax, difficulty hiring immigrants, finding people with right skillsets, and so on) as they are more accountable to shareholders and they would care less if it is US today or Brazil tomorrow, the show must go on.
    You have heard of horrific stories of people getting CDN PR and hard to find jobs. Failure stories show up lot quicker than the success stories. I have known three close ones who are well placed in Canada.

    There are always two sides of coin and so is the half glass full, a half glass empty.
    Bottomline is if such bills turn into bill, its not just immigrant community but the economy as whole gets impacted.

    Obama or Mccain or Joe the plumber whoever becomes the next president, the bottom line is, nothing is going to happen with regards to reforms for legal immigration atleast for teh first 1-2 years. So we are all still going to keep posting in IV forums, predicting VB dates and fighting between Eb2 and Eb3..... that is really the sad reality....... because these guys have far more important issues to deal and to steer titanic america.......

    Again, as I mentioned, we are jumping all over the board with different ideas and opinions. This leads to no where. Someone who has good understanding of USCIS / DOS / Govt procedures should come up with an agenda and move forward from there. We'll need to work with IV leadership team too. (At this time, I don't think they are even looking into this effort, as understandably they have other goals in hand). However, we should approach them with concrete plan of action.

    Everyone is willing to Donate $$$. But for what? What are we going to spend that money on?
    We need focused efforts.

    Lets join hands and maybe the OP can take the lead in preparing the agenda / plan of action.

    What say you guys?

    Bottom line: I believe we can do! Of course, we need to procure support from multiple sources like some of the ideas mentioned by the posters CompleteAmerica, Talking to senators on Aug 15th, etc.

    Well the plan for now has to be just brain-storming. So let's compile the best ideas from here and make a list. So let's suggest our ideas and discuss the merits and de-merits of each of them

    We should have some criteria to evaluate the ideas. I propose (in order of importance):

    - Can be done with admin fix
    - Controversy. Would like path of least resistance
    - Addresses EB3 problem

    All are free to develop upon these..

    I am EB3 India working for a small company in construction design industry. I have enough experience, qualifications and degree for an EB2. But it is not as simple as you make it sound.
    A major part- 8 out of my 15 year experience in this field has been with this employer and although my employer supports me, they are simply not hiring and have been having a difficult time since 2007. So, they cannot file for an EB2 Labor.

    I cannot change jobs, since my qualifications and experience will put me in a different job-description and title which I cannot because of how AC21 interprets the laws.

    So it is not as white and black as you make it sound. Most EB3 folks started their process way early in their careers and have moved on since. Some of us have been waiting for 10 years and have been in the country for 15 or more years.
    Some started during the last recession in 2001-2002 when EB2 was in scrutiny and dates were current for all, most employers and lawyers were touting the EB3 route.

    Anycase, I do not expect you to understand our situation. So continue speeding on your path of joy.

    same boat here, i bet many others do so.
    back in 2003 when my friend insisted to have my GC file in EB2, my attorney filed in eb3 convicing me saying all are current why bother. ( praying a cleaner route to hell for that attorney ).

    I am worried about this financial reports. I am not sure many consulting companies will give those to employee who is leaving

    Yes, I believe, most companies (new employers - mid level) would not even ask and if requested and you can not provide then generally they may not make a big deal but underlying result for asking is to check if financial strength is "Good" and I-140 is approved then no problem hiring an EAD holder.
